Chapter 15 - The living Library: Protecting Indigenous Intellectual Property in the Age of Biopiracy
Synopsis
Indigenous knowledge, passed down through generations, serves as a living library of wisdom may it be in any field that is medicine, agriculture, ecology, etc. but as the modernization and globalization continues, we are getting detached from our roots. The dynamic and rapid biotechnological advancements have become a threat of biopiracy to the existing invaluable heritage that is the chances of the unauthorized commercial exploitation of traditional knowledge and biological resources. To counter this, there exists a principle of Free, Prior, and Informed Consent (FPIC) which plays a crucial role in ensuring that indigenous communities retain control over their knowledge and resources, preventing exploitation by requiring their explicit approval before any commercial or research-related use. This paper examines the challenges of protecting indigenous intellectual property (IP) within existing legal frameworks, focusing on gaps in international treaties such as the Convention on Biological Diversity (CBD), the Nagoya Protocol, and the World Intellectual Property Organization (WIPO) Traditional Knowledge Division extending focus on the recent WIPO developments, including the progress in negotiations under the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge, and Folklore (IGC) as a step to protect traditional knowledge and genetic resources. It further explores sui generis protection mechanisms, community-led documentation initiatives, and the role of patent law in preventing biopiracy. Additionally, the paper assesses case studies of indigenous communities successfully reclaiming their rights and proposes legal and policy recommendations for equitable IP governance. By advocating for a balance between innovation and ethical preservation, this research highlights the urgent need for a global legal framework that recognizes indigenous communities as rightful factors of their intellectual and cultural heritage.
